We are strongly committed to protecting your privacy as well as your private and personal data. We collect, save, and use your personal data only in accordance with the provisions of this Privacy Statement and the applicable data protection provisions, including without limitation the European General Data Protection Regulation (GDPR) and national data protection provisions.

With this Privacy Statement, we wish to inform you to what extent and for what purpose your personal data is processed in connection with the use of our online offer.

Definitions of terms

Personal data

Personal data is all information about an identified or identifiable individual. This includes information about your identity such as your name, your e-mail address, or your postal address. However, any information that cannot be directly linked to your identity (e.g. statistical details such as the number of users of the online offer) is not considered to be personal data.

You can essentially use our online offer without disclosing your identity and without providing any personal data. In that case, we will collect only general information about your visit to our online offer. However, personal data will be collected from you for some of the services offered. Processing personal data

We store the information provided by you on protected dedicated servers located within the European Union. Technical and organisational measures are taken to protect such servers against loss or destruction, access, modification, or dissemination of your data by unauthorized persons. Access to your data will be permitted only to a limited number of authorised persons. Such persons are in charge of the technical, commercial, or editorial support of the servers. Notwithstanding regular checks, full protection against all risks cannot be provided.

Your personal data is transmitted over the Internet in encrypted form. We use TLS (Secure Socket Layer) encryption for transmission of data.

Disclosure of personal data to third parties

We use your personal information at all times exclusively to provide the services that you have requested from us. Insofar as we use external service providers in performing the service requested, such external service providers will also access the data exclusively for the purpose of performing the service. By taking the necessary technical and organisational measures, we ensure compliance with data protection standards and require our external services providers to do the same.

Moreover, we will not disclose the data to any third parties, including without limitation for advertising purposes, without your express consent. We will disclose your personal data only if you have consented to disclosure of the data or insofar as we are entitled or required to do so under legal provisions and/or administrative or judicial orders. This may include, without being limited to, giving information for purposes of criminal prosecution, in order to avert danger, or in order to enforce intellectual property rights.

Insofar as we transmit your personal data ourselves or through service providers to countries outside the European Union, we do so in compliance with the specific provisions set out in Article 44 et seq. of the GDPR and require our service providers to comply with such provisions. We will therefore transmit your data to countries outside the European Union only in compliance with the level of protection ensured by the GDPR. Such level of protection is ensured among other things by an adequacy decision of the EU Commission and/or by appropriate safeguards under Article 46 of the GDPR.

Legal basis for data processing

Insofar as we obtain your consent to processing your personal data, the legal basis for data processing is Article 6(1)(a) of the GDPR.

Insofar as we process your personal data because processing is necessary for the performance of a contract or is necessary under a quasi-contractual relationship with you, the legal basis for data processing is Article 6(1)(b) of the GDPR.

Insofar as we process your personal data because processing is necessary for compliance with a legal obligation, the legal basis for data processing is Article 6(1)(c) of the GDPR.

Furthermore, Article 6(1)(f) of the GDPR may constitute the legal basis for data processing, if processing of your personal data is necessary for the purposes of the legitimate interests pursued by our company or by a third party, except where such interests are overridden by your interests or your fundamental rights and freedoms which require protection of personal data.

Throughout this Privacy Statement, we always refer to the legal basis on which we process your personal data.

Deletion of data and duration of storage

We will delete or block any personal data provided by you as soon as the purpose of storage of such data ceases to apply. However, we may continue to store your personal data if such storage is governed by legal provisions to which we are subject, including without limitation the legal obligation to retain business records and documentation. In such a case, we will delete or block the personal data after the prescribed period of time has expired.

Use of our online offer

Information relating to your computer

Every time you access our online offer, we collect the following information relating to your computer, regardless of whether or not you have registered: the IP address of your computer, the request of your web browser, and the time stamp of that request. In addition, the status and the amount of data transferred in the course of the request are recorded. We also collect product and version information of the web browser used and the operating system of the computer. Furthermore, we record the website from which our own online offer has been accessed. The IP address of your computer is stored only for the duration of your use of our online offer; afterwards, it is deleted or anonymised by truncation. The remaining data is stored for a limited period of time.

We use this data to operate our online offer, including without limitation for troubleshooting, or to assess the degree of utilisation of our online offer, or to carry out adjustments or improvements thereof. Such purposes also constitute our legitimate interest in data processing in accordance with Article 6(1)(f) of the GDPR.

Integration of third-party services

We use third party services to deliver some of the functions of our online offer. Most of these services are optional functions that must be explicitly selected and/or used by you. We have made contractual agreements with the respective providers for the provision and/or integration of their services and use our best efforts to ensure that such third-party providers also provide transparent information about the scope of the processing of personal data and comply with data protection regulations.

etracker

For our online offer, we use the analytics services of the company etracker GmbH, of Erste Brunnenstrasse 1, 20459 Hamburg. The technologies of etracker allow an analysis of your user behaviour. We use the No Cookies option of etracker so that no cookies are used as part of the technical process. With the help of etracker technologies, we collect and store the following data:

  • Frequency of page views
  • Search terms used
  • Use of website functions
  • Shortened IP address
  • Date and time of the request
  • Access status/HTTP status code
  • Data quantity transferred in each case
  • Website from which the request comes
  • Browser
  • Operating system and its interface
  • Language and version of the browser software

When storing visitor data, certain data, including without limitation visitors’ IP addresses, device and domain data, is stored in truncated and/or encrypted form only so that the individual user cannot be identified based on the data. The data collected is never merged with other existing data, e.g. for the purpose of identifying an individual.

The IP address is truncated automatically by default at the earliest possible stage without you as a user being required to carry out any special adjustments or configurations.

We use etracker in order to enhance and optimise the quality of our online offer and its contents and in order to revise and enhance the reach and findability of our online offer.

Your consent pursuant to Article 6(1)(a) of the GDPR is the legal basis for data processing.

Use of Google Fonts

Our online offer uses Google Fonts as third-party resources. Google Fonts originate from Google and are provided free of charge. To integrate Google Fonts, the required data is requested from a server, typically a Google server. When such a request is made, the server is informed about our web pages that you have visited. Also, Google stores the IP address of the browser on the visitor’s end device accessing the web pages. It cannot be ruled out that during that process data is transmitted to the USA and that US security authorities may gain access to that data. The provisions of Article 6(1)(f) of the GDPR form the legal basis for integration of Google Fonts; our legitimate interest is to optimise our online offer.

Use of Vimeo

Our online offer embeds videos from the Vimeo video platform. That service is operated by Vimeo LLC, 555 West 18th Street, New York 10011, USA (hereinafter: “Vimeo”).

If you access a web page of our online offer which embeds a video from Vimeo, a connection with the Vimeo servers is created. Vimeo may use cookies to analyse your user behaviour. If that happens, the server is informed about the web pages of our online offer that you have visited.

If you are logged in to your Vimeo account at that time, you enable the provider to directly assign your browsing behaviour to your personal profile. We use Vimeo so we can show you videos and inform you about us and our services. Our legitimate interest within the meaning of Article 6(1)(f) of the GDPR forms the legal basis for embedding the videos; however, the playing of the videos and the associated further data processing are only carried out on the basis of your consent within the meaning of Article 6(1)(a) of the GDPR.

Social media

In addition to our online offer, we use various social media channels for purposes of information and communication; you may find links to such channels in our online offer and/or links to our online offer in such channels. More specifically, we use the social networks Facebook, LinkedIn and Instagram. No personal information is forwarded to the relevant providers before you have clicked on the corresponding links. Facebook Fan Page

In addition to our own online offer, we maintain a fan page on the Facebook social network. We use the fan page to post information about our activities and provide a channel for communication. The Facebook social network is operated by Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland (hereinafter: “Facebook“).

Limitation of responsibility

We try to ensure the protection of your privacy and personal data within the range of possibilities offered by Facebook. Insofar as we process your personal data in connection with your visit to our fan page, this Privacy Policy applies without restriction or reservation. Please note that since the fan page is integrated into the Facebook offering, personal data are at the same time processed by Facebook. We have no influence on the data processing by Facebook; in particular, Facebook does not act as a data processor on our behalf. In terms of data protection law, joint controllership of Facebook and ourselves must be assumed for the operation of the fan page and/or analysis of user data when the fan page is visited. Facebook Insights

Facebook offers the operators of fan pages the possibility to gain insights into the use of the fan pages and their users via the Page Insights functions. The Page Insights function allows viewing and evaluation primarily of statistical data. We use the data obtained via Page Insights to make the fan page as attractive and efficient as possible. To this end, Facebook provides us with data generated by Facebook itself. Messenger

Facebook offers users registered with Facebook the possibility to communicate directly via Facebook Messenger. If you contact us via Messenger, the transmitted data will be stored and used by us solely to respond to your inquiry. Your consent within the meaning of Article 6(1)(a) of the GDPR and our legitimate interest within the meaning of Article 6(1)(b) of the GDPR form the legal basis for processing of your data. In that case, our legitimate interest lies in recording and processing customer inquiries, evaluating customer inquiries, and monitoring abuse.

The data is deleted as soon as it is no longer needed for the purposes for which it was collected. With regard to your personal data this is the case once the relevant conversation has ended. For us, the conversation has ended if circumstances show that the relevant issue has been finally resolved. You can revoke your consent to the processing of the data at any time; in that case, we will delete the data immediately unless there is reason for continued storage.

The Instagram Insights function allows viewing and evaluation primarily of statistical data. We use the data obtained from Instagram Insights to make the Instagram account as attractive and efficient as possible. To this end, Facebook provides us with data generated by Facebook itself on its own responsibility. The data we receive from Facebook is mostly anonymised data and statistics. Insofar as we receive any personal data in this context, we are responsible for further processing of such data by us for the purpose of evaluating the use of our Instagram account.

On Instagram, you have the possibility to communicate directly with us via the Instagram Direct Messaging function.
